Complainant awarded €5,000 due to unfair procedures despite substantially contributing to her own dismissal

The Complainant was dismissed from her post as a Maternity Care Assistant on 21st February 2017 following an incident in which she failed to follow proper procedures. The Complainant submitted that she had admitted her actions and apologised. She stated that the sanction was punitive and it was not her intention to deliberately breach any policy or her contract of employment and was seeking reinstatement. The Adjudicator noted that she was told of the allegations made against her, given the right to representation, the right to defend herself and the right to appeal, all of which the Complainant availed of. Without prejudice to the aforementioned, and the Adjudicators conclusion that the dismissal was substantially fair, the Complainant was awarded €5,000 as the Adjudicator was not convinced that alternatives to dismissal were properly considered.
